Introduction
Afzelius-Alm Art (”We” or “I”) operates the site afzeliusalmart.com (”Site”). Detailed contact information is shown below. These terms and conditions of sales (”Terms”) apply when You as a consumer (”You”) place an order through the Site’s shop where You can buy products.

Prices and fees
The prices indicated on the “Site” are inclusive of VAT, but do not include fees such as delivery charges or payment fees. In the check-out cart of the shop, You will see the total price, including applicable fees. When ordering original ready-made artwork and commissions I will quote You the delivery fee upon request.

You need to be over 18 years of age to buy from this Site.

Afzelius-Alm Art reserves with no obligations attached for products to be sold out, any image, any typographical errors on the Site and incorrect prices and adjustments such as currency fluctuations or misinformation regarding whether the product is in stock. Afzelius-Alm Art has the right to correct,errors and to change information at any time to our own discretion. Prices for our products may be subject to change without notice.

Payment methods
Afzelius-Alm Art uses PayPal for payment of items from the Site's online shop. PayPal also offers possibility to use regular credit or debit card during checkout if You don't have a PayPal account.

For commissions and original artwork, full payment is required before I ship the artwork to You. Shipping costs will be added to the price of Your artwork. You will receive an invoice via e-mail and payment can be made via electronic bank transfer or PayPal Business.

During exhibitions carried out mainly in Sweden I also offer payment through company Swish or card payment with Visa, MasterCard, American Express and Union Pay with iZettle solution.

Shipping and delivery
Once payment has cleared for ready-made originals, the artwork ships within about 2-5 working days, domestically or internationally.

Depending on Your location and without any commitments the delivery will normally be made within 1-2 weeks (5-10 working days) of Your confirmed purchase and cleared payment. You will receive an email regarding delivery date and a tracking number upon shipment. Delivery times may vary slightly per destination and carriers. Shipping mostly occurs through PostNord and UPS or other suitable shipping company.

Of course, You are also most welcome to pick up an ordered painting directly from my studio in Sigtuna, Sweden.
Please note that shipment outside of the European Union may be subject to additional customs fees or import taxes. You are responsible for paying such additional fees and taxes.

Unclaimed delivery and delays
If Your product has not been collected from the delivery point, I reserve the right to charge all costs arising in connection with this return to You. Delays in delivery might occur due to unanticipated occurrences. There are no obligations nor commitments from Afzelius-Alm Art on delivery delays.   
 
Damaged during transit
The artwork is fully insured (against damage or non-delivery) during transit from Afzelius-Alm Art to You. I take great care to ensure the work is well packed to avoid damage. You are obliged to inspect the packing and goods upon receival. For insurance reasons, any damages need to be reported to the transport company immediately upon receival of the goods. Please also contact me immediately, if Your delivery arrives damaged. Failing to report damage upon receival will result in You losing all rights to claim the artwork as damaged during transport.

Returns
Because I am a small shop and work hard to ensure that all my pieces of art are of the highest quality, I cannot accept returns or exchanges for non-damaged paintings i.e. I do not accept cancellations nor returns for Your convenience.

Afzelius-Alm Art is responsible for treating Your information in compliance with applicable data protection legislation (personuppgiftslagen (1998:204)).

Copyrights
The title of artwork ownership will pass to the purchaser upon cleared receipt of payment. Copyright of the artwork will remain with me, the artist. Artwork and designs must not be copied or reproduced in any way without my written permission.

Force Majeure
Afzelius-Alm Art is not responsible for delays caused by circumstances outside of our control such as general labour conflict, war, fire, lightning strikes, terrorist attack, as amended agency regulation, technical problems, failure of electric/telephone/data links or other communications or fault or delays in services from subcontractors due to circumstances stated herein. These circumstances shall constitute grounds for freedom from liability and other sanctions. If such circumstances arise Afzelius-Alm Art will inform You of the current situation. If the event lasts longer than two months; both You and Afzelius-Alm Art are entitled to cancel the purchase with immediate effect.

Change of contract terms
Afzelius-Alm Art reserves the right at any time to withdraw or modify these Terms. New conditions will be published without notice. Changes apply from the time You have accepted the Terms (in conjunction with a new purchase).  If the competent court or authority or the National Board for Consumer Disputes (Allmänna reklamationsnämnden) finds that any provision of these Terms is invalid or unenforceable, the provision in question and all other provisions shall remain in force and enforceable to the extent allowed by applicable law. The provisions declared invalid or unenforceable will be replaced by the relevant legal guidance and advice.

Liability
Afzelius-Alm Art shall not under any occasion be liable for any direct, indirect cost or consequences such as but not limited to loss of profit. Any liability is limited to the total price of Your order. Nothing in these Terms shall exclude or limit Afzelius-Alm Art’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

Governing Law and Disputes
These Terms shall be governed by the laws of Sweden, notwithstanding any provisions of conflicts of laws. Nothing herein shall prevent the application and enforcement of mandatory law. Disputes shall primarily be resolved by consensus after discussion with Afzelius-Alm Art. In any dispute, we will follow the decision of the National Board for Consumer Disputes or ultimately by the courts of Sweden.
